Outstanding debts in South Africa are currently at an all time high and increasing monthly.    R Billions worth of claims are annually written off or lost by claimants due to the following two main factors:

  • Lack of access to top class professional legal representation. (Most of the top legal / attorneys firms in the RSA are contracted to Financial Institutions and may not act for any claimant against these Institutions)
     
  • Lack of funding to appoint and retain able legal advisors to initiated and sustain any long protracted legal Court case.
     
  • Claimant’s real fear of losing their claim action. Such a result could easily take any claimant into bankruptcy and/or end up in the claimant losing all his /her assets.
     
  • Litigation is also very traumatic for claimants and with intimidation always the common tactic used by larger better funded defendants plus their unfair access to experienced and expensive representative, it usually result in most claimants refraining from taking on any litigation.

 

INTERNATIONAL COMMERCIAL LITIGATION / THIRD PARTY FUNDERS

 

Prior to the turn of the Millennium third party Litigation Funding and Funders were unheard of.

 

  • Since 2004 and especially as from 2010 several  international commercials debt recovery groups,insurance companies and banks have commenced with the forming and registration of their own Litigation Funding Divisions or associated companies.
     
  • SALFCO are now engaged with several of the leading International LF groups that have agreed to entertain investments in SALFCO sourced South African claims

 

POST COMMENCEMENT FINANCE

 

  • Chapter 6 of the new Companies Act 71 of 2008 have created not only assistance for Financially Distressed companies but have also created opportunities for investors to invest into controlled and safe instruments. All Post Commencement Funding  ( "PCF") has super -preferent status when companies are placed in Business Rescue or subsequently in Liquidation.
